Warranty Information
One-year Limited Warranty
Houser Racing warrants that its products (“Products”) will be free from
defects in workmanship and material for a period of one (1) year following the
date of shipment from Houser Racing (“Warranty Period”). The original
purchaser must notify Houser Racing of any alleged defect within the
Warranty Period. Houser Racing will, at its option, and as the purchaser’s
sole remedy, either repair or replace the defective Product. The foregoing
warranty shall not apply to any Product that has been repaired or altered in
any way or has been subject to misuse, abuse, improper assembly, improper
maintenance, or any other occurrence beyond the control of Houser Racing.
The foregoing warranty is the sole and exclusive warranty given by
Houser Racing and is to the exclusion of all other warranties, express
or implied, including without limitation those of merchantability and
fitness for a particular purpose.
Purchaser understands and recognizes that Houser Racing manufactures
and sells racing components and equipment that may be subject to differing
conditions and manners of usage over which Houser Racing has no control.
Purchaser is solely responsible for determining the suitability of any Product
for a particular application without relying on opinion or recommendation of
Houser Racing. Houser Racing makes no representations about the
suitability of any Product for any particular application.
HOUSER RACING EXPRESSLY DISCLAIMS ANY LIABILITY FOR
PROPERTY DAMAGE OR BODILY INJURY (INCLUDING DEATH)
RESULTING FROM THE IMPROPER ASSEMBLY, INSTALLATION, OR
USE OF ANY PRODUCT, AND BY PURCHASING OR USING ANY
PRODUCT, PURCHASER RELEASES HOUSER RACING FROM ANY
SUCH LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, HOUSER RACING SHALL NOT BE LIABLE FOR ANY
CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, LOSSES,
EXPENSES, OR INJURIES ARISING FROM THE USE, MISUSE, OR
IMPROPER INSTALLATION OF ANY PRODUCT MANUFACTURED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN
WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME
OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND IN SUCH
JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT
PERMITTED BY LAW.
